Privacy Policy

1. Introduction and Nature of the Service

1.1 Tiffin Xpress operates tiffinxpress.co (the “Platform”), an online marketplace that connects customers who wish to purchase fresh, home-cooked meals (“Customers”) with independent restaurants/home-based chefs (“Vendors”).

1.2 Tiffin Xpress is not a restaurant, food manufacturer, or seller of food. The legal contract for the sale of each meal is formed directly between the Customer and the Vendor. Tiffin Xpress only provides technology, payment processing, and (in some cases) delivery coordination services. By using the Platform you accept these Terms of Service and our Privacy Policy (available at tiffinxpress.co/termsandconditions).

2. Eligibility

You must be at least 13 years old to use the Platform. If you are under the age of majority in Ontario (18), you represent that you have the permission of a parent or legal guardian.

3. Account Registration

You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to provide accurate, current, and complete information and to update it promptly if it changes.

4. Placing Orders

4.1 All meals are prepared by independent Vendors in their restaurants/private home kitchens.

4.2 Menu descriptions, photographs, ingredients, and allergen information are provided by the Vendor. Tiffin Xpress does not verify or guarantee their accuracy.

4.3 When you place an order, you are making an offer to purchase directly from the Vendor. The Vendor may accept or reject the order at their discretion.

4.4 Prices shown include applicable taxes and any delivery fee. Tips are optional and go directly to the Vendor or delivery person.

5. Allergies and Dietary Requirements – IMPORTANT

5.1 Meals are prepared in restaurants/home kitchens that may contain common allergens (peanuts, tree nuts, dairy, eggs, wheat, soy, sesame, fish, shellfish, etc.). Cross-contamination is possible.

5.2 You are solely responsible for reviewing ingredient and allergen information and deciding whether a meal is safe for you. Tiffin Xpress and its Vendors cannot guarantee that any meal is free of allergens. If you have a severe allergy or medical condition, you should not order from the Platform.

6. Delivery

Delivery times are estimates only. We aim to deliver within the selected time slot, but delays may occur due to traffic, weather, Vendor illness, or other circumstances beyond our control. Late delivery does not entitle you to a refund unless the meal is more than 90 minutes late and you notify us within 2 hours of the end of your chosen slot.

7. Cancellations, Refunds and Credit

Because food is perishable, the following policy applies:

7.1 You may cancel an order for a full refund up to 10:00 p.m. the day before the scheduled delivery date.

7.2 After that time, no refund is available unless:

(a)    the Vendor cancels the order,

(b)    the order is not delivered at all due to a Platform or Vendor error,

(c)    the wrong meal is delivered, or

(d)    the meal arrives spoiled or unsafe to eat (with photo evidence submitted within 2 hours of delivery).

In these cases, we will provide a refund or account credit at our discretion. Nothing in these Terms limits your statutory rights under the Ontario Consumer Protection Act, 2002.

8. Subscriptions and Free Trials

Meal-plan subscriptions automatically renew until cancelled. You may cancel at any time in your account settings with no charge for future periods.

9. Payments

We accept major credit and debit cards. By providing payment details you authorize us (or our payment processor) to charge the total amount shown. All payments for meals are held by Tiffin Xpress and released to the Vendor (minus our service fee) after successful delivery.

10. Customer Conduct

You agree not to misuse the Platform (including placing fake orders, harassing Vendors, or attempting to contact Vendors outside the Platform).

11. Limitation of Liability

To the fullest extent permitted by law:

11.1 Tiffin Xpress is not liable for the quality, safety, or legality of meals prepared by Vendors.

11.2 Our total liability to you for any claim arising from a single order is limited to the amount you paid for that order.

11.3 We are not liable for indirect, incidental, or consequential damages.

12. Indemnity

You agree to indemnify Tiffin Xpress against any claims arising from your misuse of the Platform or your violation of these Terms and Conditions.

13. Privacy

Your personal information (including delivery address and dietary preferences) is collected, used, and disclosed in accordance with our Privacy Policy and applicable Canadian privacy laws (PIPEDA).

14. Dispute Resolution and Governing Law

14.1 These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

14.2 Any dispute that cannot be resolved informally will be resolved in the courts of Ontario. You retain all rights you have under the Consumer Protection Act, 2002 (Ontario), including the right to bring a claim in Small Claims Court.

15. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of material changes by email or by posting a notice on the Platform. Your continued use after the effective date constitutes acceptance of the updated Terms and Conditions.
